Statement from Seanad Committee on Procedure and Privileges

It has received confirmation that, as there is yet to be established an Inquiry Committee, the procedures in relation to assessing whether a perception of bias arises in an individual member under the Act of 2013 cannot be invoked.  Once the terms of reference resolution is passed by the House setting out the subject matter of the proposed Inquiry, and the Committee tasked with carrying out the Inquiry is named, the CPP will have a clear role in the determination of whether a perception of bias arises in relation to an individual member.  This function can be invoked by either the individual member in question or by virtue of a complaint received by the CPP from any person.  Any such decision will be based on the evidence submitted to the CPP and in line with the procedures as set out in Standing Orders.  The final decision as to whether a perception of bias might arise in relation to an individual member rests with the House in question.
