Question:

192 Mr. McGuinness asked the Minister for Finance if his Department will examine complaints made by a person (details supplied) in County Carlow regarding the procedure adopted by the Revenue Commissioners in investigating the affairs of his company; if a meeting can be arranged between the officials and this person in an effort to resolve the issues raised; if all further action by the Revenue Commissioners can be suspended until all issues of procedure are clarified and his rights are restored; and if he will make a statement on the matter. I am advised by the Revenue Commissioners that the DPP directed that a prosecution be initiated against the person referred to, arising out of a report received by him on an investigation conducted by the Garda into the tax affairs of two companies of which he is a director. The case came before the Circuit Criminal Court in Carlow on 27 May 1998 in respect of 13 offences under the Tax Acts and the Larceny Act, 1916, and was adjourned for six weeks.

As the case is before the courts I cannot, therefore, comment further on the matter. I can confirm that the complaints have been passed to the Revenue Commissioners for their consideration.
