Question:

38 Mr. Stagg asked the Minister for Education and Science the action he has taken on foot of the Data Protection Commissioner's report and criticism of the use of the teachers' payroll database to withhold pay from teachers engaged in industrial action; and if he will make a statement on the matter. [28224/01]

The authorities of secondary schools are required to notify my Department on specially designed "absence returns" forms of teacher absences and the reasons therefor.

In the light of the decision of the data commissioner in relation to deductions from the salaries of teachers who were engaged in industrial action, my Department has used the information submitted by school authorities on the relevant forms to determine whether deductions should be made from the salaries of individual teachers.
