Question:

158 Ms O'Sullivan asked the Minister for the Environment and Local Government his views on the Supreme Court decision which obliges Cork Corporation to collect domestic refuse from householders who have not paid the relevant charges for the service; if he will provide funding to all local authorities to discharge their legal obligations in this regard; and if he will make a statement on the matter. [31049/01]

The substance and implications of the Supreme Court judgment delivered on 8 November 2001, including the possible need for appropriate legislative provision, are currently being considered in my Department.

Where a local authority takes successful court proceedings for the recovery of a charge due to it, it is open to that authority also to seek the award of costs concerned. Accordingly, I have no proposals to provide funding to local authorities in relation to such legal proceedings.
