88 Mr. J. Bruton asked the Tánaiste and Minister for Enterprise, Trade and Employment if she will be proposing a constitutional amendment to provide, in the programme for Government, for mandatory mediation for the purpose of improving the early settlement of claims and controlling legal and other costs. [13469/02]

An Agreed Programme for Government contains a commitment to establish a personal injuries assessment board. Towards that end, I expect shortly to present to the Government, in accordance with the usual procedures, the report of the interdepartmental implementation group, which I can confirm I received recently. I intend to make the report public after it has been considered by the Government. The group examined the legal implications, including what legislative changes, if any, will be necessary to establish the PIAB. The work also included consideration of the structures and operational procedures for the board.
