Question:

61 Mr. Timmins asked the Minister for Agriculture and Food if he will outline what happened to the court of the Irish Land Commission and where it went; where the records are which were held by the court; and the reason it is not mentioned in the Land Commission Dissolution Act 1992. [11272/03]

The Irish Land Commission (Dissolution) Act 1992, which was commenced by ministerial order on 31 March 1999 provides at section 3(1) that the jurisdictions vested in the office of judicial commissioner and in the appeal tribunal are vested in the High Court and shall be exercised by the President of the High Court or where he so directs by an ordinary judge of the High Court assigned in that behalf by him. Section 15 of the Land Act 1965 had previously provided that the powers and functions of the judicial commissioner and the Land Commission in relation to the distribution of purchase money could be exercised by such examiners of the Land Commission as the Minister, with the consent of the judicial commissioner may authorise for the purpose. The records held pursuant to functions carried out by the examiner under the provisions of the 1965 Act are retained by an examiner in my Department.
