Payment of benefit to the person concerned was disallowed from 11 December 1989 following an examination by a medical referee on 30 November 1989 who expressed the opinion that she was capable of work. She appealed this decision and was examined by a different medical referee on 18 April 1990 who also expressed the opinion that she was capable of work.
Her case was then referred to an appeals officer who upheld the decision to disallow payment of disability benefit from 11 December 1989. The decision of the appeals officer is final and can only be altered in the light of new facts or fresh evidence.
Medical evidence submitted subsequently by the Deputy on the claimant's behalf has been referred to the Department's medical adviser for consideration and the case will be referred back then to the appeals officer to decide if a revision of the decision is warranted.
