Question:

41 Mr. G. Mitchell asked the Minister for Finance if the Revenue Commissioners will agree to waive taxes on the succession to a home in the case of a person (details supplied) in Dublin 12 in view of the circumstances.

I am informed by the Revenue Commissioners that probate tax, which is a self-assessed tax, is charged at 2 per cent on the taxable value of an estate once a threshold of £10,150 is exceeded. In cases of hardship, the relevant legislation allows the commissioners to arrange for the tax to be paid on a phased basis over a specified period or for the payment to be deferred until the property is eventually sold. Full consideration will be given to this matter when the Revenue Commissioners are presented with the papers in this case.
