Question:

293 Mr. O'Malley asked the Minister for Justice if she will make a statement in relation to a letter written by or on behalf of her predecessor on 22 March 1991 to a company (details supplied) in Dublin 4 in view of the fact that the company concerned has been informed by the Garda that their investigations into the matters complained of are still ongoing and that no file in connection with this investigation was submitted to the Director of Public Prosecutions prior or subsequent to 22 March 1991; if she will make a statement on the ongoing investigation and when it is anticipated the investigation will be completed and the file submitted to the Director of Public Prosecutions; and the reason incorrect information was given in the letter of 22 March 1991. I am informed by the Garda authorities that in August 1990 following receipt of a complaint from the company referred to, a report was submitted to the Director of Public Prosecutions. In November 1990 the director responded to the effect that the matter complained of had no criminal connotations.

A further complaint by the company was reported to the Director of Public Prosecutions by the Garda in July 1992. Subsequent to receipt of his advice in December 1992 a Garda investigation was commenced. This investigation is substantially completed and the investigation file is being prepared for submission to the Director of Public Prosecutions for his further direction.
In relation to the letter of 22 March 1991 scrutiny of the file reveals it to be accurate in its description of the position as it existed at that time.
