Eligibility for subsidy towards the purchase of restructured quota under the 1996 restructuring scheme was determined on the basis of criteria set down by the EU Commission. These criteria were notified to all applicants for subsidy. As the person named did not satisfy these criteria, his application was unsuccessful.
