Question:

63 Mr. J. O'Keeffe asked the Minister for the Environment and Local Government if his attention has been drawn to the fact that, though planning files are open for inspection, planning offices are not allowed to provide a photocopy of any part of the file even though some of the submissions and reports may be many pages long; his views on whether this is an unreasonable restriction for those who want to prepare detailed submissions by way of response; if he will ensure that facilities are put in place for the provision of photocopies at reasonable cost to those who wish to avail of these facilities; and if he will make a statement on the matter. In 1995 my Department issued a circular letter requesting planning authorities to make copies of documents held on a planning application file, other than plans, drawings or photographs, available to the public for purchase at a reasonable fee. It should also be noted that the Local Government (Planning and Development) Regulations, 1994 require planning authorities to make available for purchase copies of environmental impact statements, or extracts from them.

Following reports that some planning authorities had not made adequate arrangements for the provision of documents, planning authorities were reminded in 1996 of the need to put arrangements in place for the provision of copies of documents, and to ensure that all relevant staff were aware of the contents of the previous circular.

It should also be noted that the issue of the availability of information in the planning system has been considered as part of my review of the planning code. My proposals in this regard will be contained in a major Bill to reform and consolidate planning law to be published in mid-year.
