SECTION 50.

I move amendment No. 203:

In page 38, subsection (2), line 14, after "half" to insert "(having regard to section 3)".

We discussed this before. I do not have a clear view on it and would welcome an opportunity for further thought. It concerns the expenditure limit which should apply in the unlikely event of a candidate dying during an election. I suggest that half the expenditure limit should be allowable for the second candidate. There was some confusion on the matter. I will withdraw the amendment and think further about it.

The Chairman made the reasonable point that this could disadvantage the new candidate.

The new candidate would have the full allowance but the intention is that he or she would not have two allowances. I wish to reconsider it anyway.

The McKenna judgment might have a bearing on this.
