Deputy Finian McGrath asked the Minister for Public Expenditure and Reform the number of applications for reinstatement, following retirement on grounds of ill health with prior notice, granted since 2004; the legislation and rules or procedure under which they were granted; and if he will make a statement on the matter. Since the establishment of my Department in July 2011, there have been no reinstatements following retirement on the grounds of ill health.

As the Deputy will be aware from my previous responses in relation to this matter, neither the Public Service Management (Recruitment and Appointments) Act, 2004 nor the relevant circular (Ill-Health Retirement from the Civil Service, 22/07) make provision for a mechanism under which an individual can apply for reinstatement following his or her retirement with prior notification on ill-health grounds.
