As part of the Government's St Patrick's Day Programme I travelled to India, visiting Mumbai and New Delhi. My programme started on the 15th March after arriving in Mumbai, and ended on the 18th March, departing New Delhi on the 19th.

I propose to take Questions Nos. 500 and 527 to 530, inclusive, together.

Ireland has responded to the largest displacement of people on the European continent since the Second World War. Since February 2022, my Department has worked to accommodate an unprecedented volume of persons seeking refuge following the invasion of Ukraine, with over 78,000 people arriving in Ireland, including 58,000 who have sought accommodation from this Department.

Overseeing provision of accommodation on this scale during this timeframe for all those who require it remains immensely challenging. Due to the urgent need to source accommodation, my Department has contracted in excess of 47,000 beds to accommodate Beneficiaries of Temporary Protection (BOTPs) in more than 750 settings including hotels, guesthouses, B&Bs, hostels, commercial self-catering accommodation and certain other repurposed settings. In addition, more than 7,000 beneficiaries have also been accommodated in pledged accommodation properties.

The priority is to place people fleeing the war in safe and secure accommodation.

The Department has concluded discussions with the provider of temporary emergency accommodation for people fleeing the war in Ukraine at the site of the former Equestrian Centre in Kill, Co Kildare. I met with representatives of residents of the Kill community on 23rd March to outline the full plans in terms of the use of the building, where the first group of 114 individuals from Ukraine is scheduled to arrive from April 24th. Further moves will take place over the following month, bringing the total number of people displaced from Ukraine residing at the centre to 340. There are no plans at this time to use the building or any part of the site to accommodate more people.

I am advised by my officials that the facility is being developed in accordance with current building regulations including newly built HVAC systems and that an appropriate fire certificate is in place. My Department has seen proof of appropriate insurance for the facility. The management of the company has experience in the commercial hospitality sector. A management office is located at the property, with out of hours security and contact arrangements in place. The facility will be staffed with a rostered team to include the facility manager, duty managers, night managers/security, food service staff and cleaners. There will be a 24/7 presence with a CCTV feed to a management office and the manager on duty will be contactable on the duty mobile number.

While all offers of accommodation received continue to be appraised, my Department is working with the Office of Public Works (OPW) to develop a proposal to use a state owned property in Shannon (Unit 153 Shannon Free Zone) for IPAS accommodation. This engagement is ongoing. My officials have advised OPW that it is satisfied with the proposed layout for the centre.

The OPW has now moved into a detailed design phase and has submitted a request for a Contractor to price the works.

The completion of works is a matter for the OPW.

The capacity available will not be confirmed until the detailed design phase is complete and agreed. My Department will engage with relevant services once work is further advanced on this project.

There are a number of issues raised in the correspondence to which the Deputy refers, which are being considered in the Department. A reply will issue directly to the individual concerned in due course.

It may be helpful to note that if a parent/guardian has submitted a complaint to Tusla, Tusla will follow up with a response directly and my Department does not have a role in relation to this process.

In relation to Core Funding Fee Management, individuals may seek to have issues examined and a conclusion reached through the Core Funding Fee Review process operated through City/County Childcare Committees (CCCs), Pobal and the DCEDIY. An individual may initiate this process by contacting their local CCC. The CCC will notify and obtain permission from the initiator before escalation of the case to Pobal.

The Fee Management Review process aims to protect the anonymity of the initiator from the Partner Service to whom their complaint relates. CCCs, Pobal and DCEDIY will at each stage protect the anonymity of initiators where possible, however anonymity cannot always be guaranteed given the variability in size of services and specific nature of individual cases. Where anonymity is to be protected, any documents issued between CCCs, Pobal and/or the DCEDIY will flag confidentiality in the subject line. All anonymous complaints about specific services received by CCCs will be recorded and brought to the attention of Pobal complaints team.

I am very conscious of the hurt that continues to be felt by survivors and family members of the people who died while resident in Mother and Baby institutions. One of the most tragic aspects of what happened in the former institution in Bessborough is the uncertainty regarding the burial place of many children who were resident there.

The investigation of burial arrangements in Mother and Baby institutions, including the institution in Bessborough, was an important part of the work of the Commission of Investigation into Mother and Baby Homes and certain related matters. The Commission concluded that it is likely that some of the children who died at Bessborough are buried in the grounds but was unable to find any physical or documentary evidence of this. The Commission carried out cartographic and landscape assessments of possible unrecorded burial arrangements and also followed up with people on responses to its appeal seeking information about burials in Bessborough. As no evidence of locations was found, the Commission did not consider it feasible to excavate the full available site, which amounts to 60 acres.

The Institutional Burials Act 2022, which came into effect on 15 July last, provides the underlying legislative basis for an intervention, whereby the remains of those who died in residential institutions, and who were buried in a manifestly inappropriate manner, may be recovered and re-interred in a respectful and appropriate way. Under the legislation, a relevant Minister may bring a proposal to Government for an intervention at a site if manifestly inappropriate burials are discovered there. The Government can, by Order, direct an intervention at the site where it is satisfied that the criteria set out in the legislation are met.

The legislation was developed in response to the abhorrent situation at the site of the former Mother and Baby institution in Tuam, Co. Galway. To avoid delays in responding to any similar situations that may arise in the future, the Act is not site specific and allows for excavations and identification programmes at other institutional sites should manifestly inappropriate burials be discovered.

In the case of Bessborough, the location of burials is, sadly, unknown. Therefore, a proposal to establish an Office of the Director of Authorised Intervention to oversee excavation, recovery and identification of inappropriately buried remains at that site cannot be brought forward under the Act.

Proposed developments in the grounds of Bessborough are a matter for the relevant planning authorities. In this regard, it is important to highlight that, last November, the Minister for Housing Local Government and Heritage wrote to all City and County Councils requesting that Development Plan processes give adequate consideration to incorporating appropriate measures to ensure the protection of unrecorded burial sites associated with an institution.

I have also publicly emphasised my view that any proposed development at the Bessborough site should have due regard to the Commission’s reports and give adequate consideration to the views of all survivors and family members, including requests for appropriate access and respectful memorialisation in due course.

I recognise the importance of delivering the Mother and Baby Institutions Payment Scheme for survivors as quickly as is possible. The legislation for the Scheme was published in October 2022 and completed its passage through the Dáil on 22nd February 2023. The Bill will move to the Seanad in the coming weeks.

The operational elements, which includes the establishment of an Executive Office to administer the Scheme, are being progressed alongside the legislation and intensive work is underway in my Department in this regard also. Subject to the legislation being passed and enacted, and the administrative structures being established, the Scheme will open for applications as soon as possible in 2023.

Around the time of its launch, a public information campaign will be undertaken both nationally and abroad. The Mother and Baby Institutions Payment Scheme will provide financial payments and an enhanced medical card to survivors and former residents of Mother and Baby and County Home Institutions in recognition of time spent in the institution, harsh conditions, emotional abuse and all other forms of mistreatment, stigma and trauma experienced while resident in a Mother and Baby or County Home Institution. A refund of disability allowance is a matter for the Department of Social Protection and is not within the scope of this Scheme.

The Mother and Baby Institutions Payment Scheme Bill has been published and is currently making its way through the Houses. The Scheme will open as soon as possible in 2023 once the legislation is passed and administrative framework is in place.
