Ceisteanna—Questions. Oral Answers. - Trade Union Act, 1941.

asked the Minister for Industry and Commerce if he intends to introduce proposals for legislation amending the Trade Union Act, 1941; and, if so, if he is in a position to indicate the nature of such proposals.

The position of the Trade Union Act, 1941, has been under consideration since the Supreme Court declared that Part III of that Act was ultra vires the Constitution. I am satisfied that it is desirable to repeal the Act and to replace it with a suitable enactment.

In 1947 I initiated discussions on the subject with trade union organisations. I invited both trade union congresses to consider and put in writing their views on legislation which should replace existing trade union law and define the status, rights and obligations of trade unions.

No progress has been made in the meantime, but I am now arranging to reopen the matter with the trade union congresses.

The answer to the Deputy's question is, therefore, that legislation is intended, but I am not yet in a position to state what its character may be or when it will be ready.
