Vol. 268 No. 13

Ceisteanna—Questions. Oral Answers. - Prison Sentence Remissions.

8.

asked the Minister for Justice whether membership of the EEC has altered the position in regard to the remission of prison sentences; and, if so, in what respect.

If the Deputy means a sentence imposed by a court on conviction of a crime, the answer is "no". If, however, the question is intended to extend to a committal order which may be made in certain circumstances for failure to obey, for example, a judgment of the European Court, then the position is that under the Community Treaties enforcement of such a judgment may be suspended only by a decision of the European Court itself.
