Vol. 322 No. 5

Written Answers. - Court Business Transfer.

345.

asked the Minister for Justice if he is aware of the confusion which exists in Bray District Court, County Wicklow, arising from the business transferred to that court from the former Shankill Court area, and the fact that the Wicklow Bar Association passed a resolution urging the transfer of the former Shankill District Court to the Dublin Metropolitan District Court with Dún Laoghaire Court as the venue; and if he will accede to this request.

346.

asked the Minister for Justice if, in view of the substantial increase in the population of Ballybrack, Loughlinstown and Sallynoggin areas of County Dublin, and the confusion and expense caused by the inclusion of these areas in the Bray District Court, he will transfer these areas to the Dún Laoghaire District Court.

With the permission of the Ceann Comhairle, I propose to take Questions Nos. 345 and 346 together.

The Committee on Court Practice and Procedure in their Twelfth Interim Report recommend, inter alia, that the Dublin Metropolitan District be extended to include the whole of Dublin city and county with the exception of the District Electoral Division of Rathmichael. It is my intention to proceed with this recommendation.

The exclusion of Rathmichael arises from the fact that, for local government purposes, it forms part of Bray Urban District. However, any request that it be included in the revised Dublin Metropolitan District would be considered on its merits.

In so far as transferring certain areas to the Dún Laoghaire District Court is concerned the position is that, in the event of the Dublin Metropolitan District being extended to include them, it would be for the President of the District Court to decide the court venue or venues at which the business from those areas would be transacted.
