Written Answers. - Young Workers' Exploitation.

asked the Minister for Labour if his attention has been drawn to recent reports alleging the exploitation of underage workers by employers; if he will outline his Department's attitude towards such allegations; and if he will make a statement on the matter.

I assume that the Deputy is referring to the recent survey by the Irish Transport and General Workers' Union Youth Committee on the operation of the Protection of Young Persons (Employment) Act, 1977. Even though the survey is a very limited one, covering only 310 young people in two second-level schools in Dublin, it will be a valuable addition to the information which is being assembled on the working of the Act.

The position is that the Protection of Young Persons (Employment) Act, 1977, contains a general prohibition on the employment of children under school leaving age, which is at present 15 years. However, section 4 of the Act provides that children under 15 years but over 14 years may engage in employment within very strict limits, as laid down in the section.

There have been more than 1,500 inspections in connection with the Protection of Young Persons (Employment) Act since it came into force. In addition the Department's inspectors, in the course of their general inspection work, have investigated the position in regard to the Act, where appropriate. There have been two successful prosecutions, papers have been sent to the Chief State Solicitor in four further cases, and prosecutions are being considered in a number of other cases.

The Act has been widely publicised and a special poster was distributed to schools and youth organisations a few years ago.

Experience in the enforcement of the Act has thrown up a number of problems and accordingly a review in depth of the provisions of the Act is being undertaken in my Department with a view to possible amendment. When amendments are proposed the House will have an opportunity to consider fully the long-term position in relation to the employment of young persons.
