Written Answers - Health and Safety Statements.

106 Mr. Durkan asked the Tánaiste and Minister for Enterprise, Trade and Employment the extent to which her Department has received health and safety statements in respect of employments throughout the country; and if she will make a statement on the matter. [14794/97]

Under section 12 of the Safety, Health and Welfare at Work Act, 1989 there is an obligation on every employer to prepare a safety statement. The safety statement specifies the way in which the safety, health and welfare of employees is secured and is based on an identification of the hazards and an assessment of the risks to safety and health of employees.

Under section 16 of the Act, one of the functions of the National Authority for Occupational Safety and Health is to enforce the provisions of the Act, including section 12.

I, therefore, have no duty or obligation to receive safety statements from employers.
