The officer in question retired from the Department of Justice, Equality and Law Reform as an estates officer having being transferred from the Department of Agriculture and Food. At the time of his retirement it was intended that the grade of estates officer would be abolished and that an officer retiring from that grade would be linked to the executive officer grade in the civil service for pension increase purposes. The grade of estates officer was not abolished at the time and will continue in existence until the difficulties vis-à-vis serving officers in that grade in the Department of Agriculture and Food are resolved.
In these circumstances, the retired officer in question has received all general round pay increases but, as there is no restructuring agreement for serving officers in his grade under the local bargaining clause of the Programme for Competitiveness and Work (PCW), he cannot benefit from PCW restructuring.
