216 Ms B. Moynihan-Cronin asked the Minister for Agriculture and Food the reason a person (details supplied) in County Kerry was not granted additional milk quota following an appeal under the 32 million gallon allocation; and if he will make a statement on the matter. [18788/03]

The allocation of the balance of the Agenda 2000 milk quota to certain categories of small and medium scale milk producers has been completed and applicants have been notified of the outcome in their own cases. An application was submitted by the person named in respect of this quota and, as he successfully satisfied the conditions of the scheme, an allocation was made in his case.

An appeal was subsequently lodged by this applicant but, based on the evidence provided, he was not eligible for a further allocation. The result of this appeal was issued to the appellant on 19 June 2003.

217 Ms B. Moynihan-Cronin asked the Minister for Agriculture and Food the number of appeals that were made for additional milk quota under the 32 million gallon allocation from farmers in County Kerry; the number that were successful; and if he will make a statement on the matter. [18789/03]

Under the appeals procedure in relation to the 32 million litre scheme, almost 2,000 cases were considered. Of these, 205 were from producers in County Kerry and 11 were successful on appeal.
