923. Deputy Pauline Tully asked the Minister for Justice the number of unmarked Garda vans attached to the Cavan-Monaghan division in the years 2023 and to date in 2024; and the number of these vans withdrawn from this division during same period. [15095/24]

As the Deputy will be aware, under the Garda Síochána Act 2005 (as amended), the Garda Commissioner is responsible for the management and administration of An Garda Síochána, including the purchase, allocation, and effective and efficient use of Garda vehicles. As Minister, I have no role in these independent functions.

The unprecedented allocation of over €2.35 billion for 2024 to An Garda Síochána demonstrates the Government's commitment to ensuring An Garda Síochána has provision for the equipment, technology, facilities, fleet and personnel it needs to carry out vital policing work.

There are now 3,513 vehicles in the Garda fleet, the highest ever and a 34% increase since 2015. 

I am informed that there were seven unmarked vans attached to the Cavan/Monaghan Division at the end of December 2023. I am further informed that the number of unmarked vans assigned to the Division had increased to 8 by the end of March 2024. I am advised that no unmarked vans were removed from the Division in this timeframe. 

I am further advised that on 31 March 2024, there were a total of 79 vehicles assigned to Cavan/Monaghan Division, which includes: 55 cars, 14 vans, 7 4x4, and 3 Motorcycles. 

I am also informed that the allocation of vehicles is monitored and reviewed on a continual basis to ensure the best match with operational requirements.

As the Deputy will be aware, under the Garda Síochána Act 2005 (as amended), the Garda Commissioner is responsible for the administration and management of An Garda Síochána, including the distribution of Garda members between the different Garda units and Divisions. As Minister, I have no role in such matters.

I am advised by the Garda authorities that there have been no appointments to the position of Detective Sergeant within the Cavan-Monaghan Division in the year 2023 and to date in 2024.

I can, however, assure the Deputy that the Government is committed to building stronger, safer communities and a strengthened, well-resourced Garda Síochána is central to this policy. This commitment is demonstrated by the unprecedented provision of more than €2.3 billion to the Garda Vote this year, which is allowing for sustained and ongoing recruitment and investment in new equipment and new vehicles.  

In addition to new recruits, the roll-out of the new Garda Operating Model will support the redeployment of Gardaí from non-core duties to front-line policing across the country. The new model will see larger Divisions with more resources, increased Garda visibility in communities, a wider range of locally delivered policing services, and a strong focus on community policing.

I am advised by the Garda authorities that as of 29 February 2024, the latest date for when figures are available, there was a total of 13,930 Garda members nationwide. This represents an increase of almost 9% since the end of December 2015. In addition, the civilianisation programme has freed up almost 900 Garda members from back office work for front line policing work since 2015.

I am informed €10 million has been allocated for investment in the Garda fleet in 2024.

As Minister, I have no role in such matters.

I am advised by the Garda authorities that the allocation of Garda vehicles is monitored and reviewed on a continual basis to ensure the best match with operational requirements. I am further advised that the table below sets out the current age profile of the Garda Technical Bureau Fleet as of 5 April of this year.

I pass on my sympathies to the family concerned and can confirm that a reply has issued to the person referred to by the Deputy.

Coroners are independent quasi-judicial office holders whose core function is to investigate sudden and unexplained deaths so that a death certificate can be issued. Neither I, as Minister, nor my Department has any function in the conduct of coronial business, nor can I comment on any individual case.

As the Deputy will be aware, the Garda Commissioner is by law responsible for the management of An Garda Síochána, including the addition of new facilities to the Garda estate. Works on the Garda estate are carried out in close cooperation between the Office of Public Works (OPW) and Garda management.

I am advised by the Garda authorities that the Estate Management Office in An Garda Síochána is working closely with the OPW and all relevant stakeholders on this project. Work for the provision of a National Centre of Excellence for the Garda Dog Unit is only at project design stage at this time. It is therefore not yet possible to provide full details of all future works, budget, or the timelines associated with the project.

Nitrates Usage

930. Deputy Catherine Connolly asked the Minister for Agriculture, Food and the Marine if he will detail, in tabular form, the number, type and outcome of Nitrate Action Plan derogation inspections for each year since 2022 to date; and if he will make a statement on the matter. [13572/24]

The Commission Implementing Decision granting Ireland's current Nitrates Derogation sets out the requirement to conduct on-farm inspections on at least 10% of farms with a Nitrates Derogation.

Of the 6,726 Nitrates Derogation applicants in 2022, a total of 718 received an on-farm inspection by officials from my Department.

These on-farm inspections identified 47 applicants that were non-compliant with the Terms and Conditions of the 2022 Nitrates Derogation. In line with the Commission Implementing Decision, these applicants were rejected from the 2022 Nitrates Derogation and subsequently ineligible to avail of the Nitrates Derogation in 2023. These farmers were then subject to the limit of 170 kg livestock manure nitrogen per hectare applicable to farmers in the absence of a Nitrates Derogation. If the farmer breached that limit, or where other breaches of Statutory Management Requirement (SMR) 1 were identified on inspection, a penalty was applied to the applicant's Basic Payment Scheme (BPS) and other Common Agricultural Policy (CAP) schemes, as appropriate.

In addition, in 2022 a further 41 Nitrates Derogation applicants were found on inspection to be non-compliant with SMR 1. In each of these cases a sanction was applied to the applicant's BPS and other CAP schemes, as appropriate.

The outcome of the inspections conducted in 2023, is not yet available as in some cases fertiliser records are still being checked following submission and final inspection details are not yet fully recorded. This work is progressing with the objective of submitting details regarding 2023 to the European Commission by the 30th of June 2024 in line with the requirements set down in the Commission Implementing Decision granting Ireland's current Nitrates Derogation.

Note: In 2022 SMR 1 referred to the Protection of Waters against Pollution caused by Nitrates. The aim of this requirement is to reduce the pollution of waters caused by nitrates and phosphates occurring from agricultural land and farmyards. This SMR applies to all CAP beneficiaries. Under the CAP Strategic Plan, effective from 2023, it is now referred to as SMR 2.

Forestry Sector

Deputy Éamon Ó Cuív asked the Minister for Agriculture, Food and the Marine when a decision will be made in relation to a felling licence application in respect of a person (details supplied) in County Galway, given the fact that the initial application has been lodged with his Department since 2018; if he can assure that a decision will issue without further delay; and if he will make a statement on the matter. As regards the felling license application referred to, my Department continues to engage proactively with the applicant and his representatives. This is a very complex location with a number of Ecological concerns which must be carefully considered. There have been a number of changes made to the initial application on foot of environmental concerns raised by my Department and an updated Natura Impact Statement (NIS), Harvest Plan and other documents were submitted at the end of December 2023. 

Upon receipt of these documents, they were issued to both National Parks and Wildlife Service (NPWS) and Inland Fisheries Ireland (IFI)  for consideration. Observations were received from the National Parks and Wildlife Service (NPWS) on the 12/02/2024, while Inland Fisheries Ireland (IFI) issued their observations on the 01/03/2024. 

My Department is considering these observations to plan the progression of the application accordingly. My Department will be in touch with the applicant once the application has reached the next stage.

Horticulture Sector

Deputy Catherine Connolly asked the Minister for Agriculture, Food and the Marine the number of times and the specific dates on which he or his Department has formally requested the European Commission to allow for a derogation or temporary derogation to facilitate the import of seed potatoes from the UK, in particular from Scotland, since the introduction of a post-Brexit ban on the import of UK seed potatoes after 1 January 2021; if he or his Department has further sought a derogation in light of the Windsor Framework in March 2023 which enabled the resumption of trade in seed potatoes into Northern Ireland; if he is aware that the Canary Islands currently imports UK and in particular Scottish seed potatoes; and if he will make a statement on the matter. The EU-UK Trade and Cooperation Agreement (TCA) sets out basis for EU-UK trade post Brexit and confirms UK decision be outside of EU Single Market and therefore UK is considered a 3rd country by EU.

The EU Commission has made clear that unless there is dynamic alignment with EU plant health standards seed potatoes originating from GB can no longer be imported into the EU.  My Department has not made any formal request to the European Commission seeking a derogation temporary or otherwise from the EU-UK TCA provisions. This position is a consequence of UK Government decision to exit EU and EU Single market.

In respect of Windsor Framework provisions they are targeted at addressing NI related issues and it is not be possible or appropriate to seek any extension of these provisions to Ireland.

The Canary Islands have a unique status within the EU as an over sea territory, and in the context of EU plant health law are considered outside the EU and not subject to the EU plant health Regulation. They apply their own plant health standards and are treated as a third country in terms of phytosanitary access to the EU.  

It is clear that UK Government Brexit decisions have presented a significant challenge for Irish potato growers. My Department has been active in supporting the sector in adapting to the new EU-UK trading environment and supporting development the Irish seed potato sector. In this context I launched the 2022 Seed Potato Scheme which carried over into 2023 to the Scheme of Investment Aid for the Seed Potato Sector and the Chipping Potato Sector. These Schemes provided for €4.6m of funding to support the development of the sector.  

There is great potential in continuing to revive the domestic seed potato sector and I can assure Deputy that I am committed to seeing it thrive.

The person named submitted an online application on 26 June 2023, for the Solar Capital Investment Scheme.

A number of issues relating to the solar survey and farm yard plan arose during administrative checks, which were queried with the applicant.  These matters have now been resolved, and a letter of approval to commence works issued on 25 March 2024.

I propose to take Questions Nos. 934 and 992 together.

Irish registered vessels are permitted to land at Magheraroarty pier in Co. Donegal. I am advised by the independent Sea Fisheries Protection Authority that in 2023 there were 205 landings, representing 467 tonnes, into Magheraroarty.

There are no current plans to include Magheraroarty Harbour as a designated port for UK vessels, given the significant extension in the number of designated ports in recent years and the levels of commitments and resources required and available.

As the Deputy will be aware, there are significant practical and cost implications for the State in the designation of EU ports for Third Country landings as, under EU Regulations, such designations represent an entry point to the European Union following which food is free to circulate within the full EU common market. On this basis for any ports designated, Ireland is obliged to ensure that it has in place a meaningful control presence.

Last year, I designated three new ports in County Donegal for landings from UK-registered Northern Ireland vessels (Bunagee, Glengad and Malin Head) as well as extending the opening hours in Greencastle. In addition, Dunmore East was also designated for landings from UK-registered Northern Ireland vessels. These four newly designated ports were additional to the seven ports already designated: Ros A Mhíl, Greencastle, Rathmullen, Burtonport, Howth, Killybegs and Castletownbere.

I should inform the Deputy that the current ports designated and the opening days and times for those ports were decided to allow for Northern Ireland registered vessels to continue to land into Irish ports, while ensuring that the Sea Fisheries Protection Authority has the capacity to continue to perform its vital control functions effectively.

I would also like to assure the Deputy that the designation of ports for landings does not preclude vessels from coming into ports for force majeure reasons such as safe harbour.

In 2023, the herdowner through his FAS Adviser selected AP 1 - Space for Nature Enhanced. My Department through the Farm Advisory Service email address issued a communication on 11 May 2023 notifying FAS Advisers that there was an issue with how some LPIS parcels with scrub exclusions were having their space for nature calculated and advising that impacted FAS Advisors would receive further follow up correspondence, which they did the next day, 12 May 2023. In many cases action was taken including either selecting another agricultural practice in Eco-schemes or drawing in more features that had not been marked on the submitted applications for agricultural practice 1 - Space for Nature. For some, no action was taken.

In that context, my officials have been engaging with impacted FAS Advisors in recent weeks and a further correspondence was issued by my Department on 22 March 2024 to approximately 300 herds (including the herd provided by the Deputy) advising that as these herds met the agricultural practice 2 measure (extensive livestock production - enhanced based on 2022 stocking rate), the Department could change the option selected from AP 1 enhanced to AP 2 enhanced on receipt of an email from the FAS Advisor. In the case of the herd provided, that confirmation was received from the FAS Advisor on 22 March 2024 and the Eco-scheme payment is currently being processed.

I have provided a table of import figures which are provided by the Central Statistics Office and refer to - Peat, including peat litter, whether or not agglomerated (CN code 27030000).  This description includes all types of peat and does not differentiate between peat used for horticulture or that used for heating. This description also includes briquettes. Peat agglomerates also includes peat substrates where peat is mixed with other materials such as fertilizer, perlite, sand, lime, wood fibre and bark. By way of example a peat reduced substrate mix of 30% Wood Fibre, 30% Bark and 40% Peat is still classed under the CN code 27030000.

My Department owns, operates, and maintains six designated State-owned Fishery Harbour Centres under statute. These centres are Killybegs Fishery Harbour Centre, Howth Fishery Harbour Centre, Castletownbere Fishery Harbour Centre, Ros an Mhíl Fishery Harbour Centre, Dingle Fishery Harbour Centre and Dunmore East Fishery Harbour Centre. 

The Fishery Harbour Centres contain a diverse property portfolio reflecting their role as working fishery harbours and as the location for a broad range of other marine activities.  The total number of properties (excluding infrastructure) across the six Fishery Harbour Centres is 263.  There are 18 vacant properties across the six Fishery Harbour Centres. Vacant properties are regularly reviewed by my Department to assess their suitability for making them available for tender to interested applicants and to provide rental income for the Fishery Harbour Centres Fund. 

Longtown Farm is owned by OPW and is managed by my Department, which is responsible for the properties on the farm.  Plans are in place to renovate Longtown Farm Gate Lodge through OPW for use by my Department.   

The property on Backweston Farm is currently vacant and a new farm manager is expected to be appointed shortly and will reside in the house.  This is a condition of employment.

Movement of livestock manure between holdings must be recorded and verified online on www.agfood.ie. In a small minority of justified cases (e.g. deceased farmer), paper records of movements will be accepted.

Farmers do not have to employ an agricultural advisor to record an export of organic manure, such as slurry, or to verify an import of organic manure.

To record a movement online, a farmer must have an agfood.ie account. Where a farmer does not have an agfood account already, they can seek to have one set up by emailing: agfood@agriculture.gov.ie.

The online manure movement system is quick and easy to use. A user manual for farmers and agents (i.e. advisors), and a video guide regarding the online slurry movement system are available to access and view on my Department's website at www.gov.ie/nitrates.

To date no farmer has been directly penalised for a failure to declare their organic manure movement. However, not declaring an organic manure export or not having it verified, may have resulted in certain farmer’s annual livestock manure nitrogen (N) exceeding their holding's maximum allowable limit of 170 kg N/ha, or in the case of derogation farmer last year, 250 kg N/ha. Farmers who breach their allowable livestock manure nitrogen limit incur a sanction on their Basic Income Support for Sustainability (BISS) Scheme and other CAP payments, as appropriate.

If a Nitrates Derogation applicant breaches their derogation limit they will be rejected from the derogation for the year concerned and are not eligible to avail of a derogation in the following year.

Following exceptional flooding in the Shannon Callows during summer 2023, on 7 November 2023 I announced the launch of the Shannon Callows Flood Scheme. The aim of the scheme is to support farmers who have lost fodder due to flooding in the region during summer 2023. I have allocated funding of approximately €800,000 which will allow for a payment rate of up to €325 per hectare. This is for LPIS parcels in the Shannon Callows impacted as determined by my Department's Earth Observation team, utilising the Area Monitoring System, and which were claimed by farmers on their 2023 Basic Income Support for Sustainability (BISS) application. 

Some farmers with LPIS parcels in Lusmagh, County Offaly, that are within the Shannon Callows area and which met the eligibility criteria for the scheme as set down in the Shannon Callows Flood Scheme Terms and Conditions have received payment. There are however other farmers within the area who did not receive payment as either the parcels were not detected as being flooded or where they were detected as flooded, they did not meet the minimum of six flood occurrences over the course of the 30 occurrences between 2 July 2023 and 29 September 2023.

Rásaíocht Con Éireann (RCÉ) is a commercial state body, established under the Greyhound Industry Act, 1958 chiefly to control greyhound racing and to improve and develop the greyhound industry. RCÉ is a body corporate and a separate legal entity to the Department of Agriculture, Food and the Marine.

The questions raised by the Deputy are an operational matter for RCÉ and, therefore, the questions have been referred to the body for direct reply.
