The arrangements which will apply to the operation of enhanced co-operation are set out in the Treaty of Nice.
Enhanced co-operation can only be used as a last resort when the objectives involved cannot be achieved through any other means within a reasonable period. Any proposal to create an enhanced co-operation project must be endorsed by the Council of Ministers – by QMV or unanimity depending on the area. A group must involve the participation of at least eight member states. It must be open to all of them, both when it is established and at any time thereafter. A project must not undermine the single market, must not be a barrier to free trade and must not distort competition between member states. Enhanced co-operation can never be used in the area of defence.
Enhanced co-operation was first provided for in the Treaty of Amsterdam. The Treaty of Nice made some adjustments to the procedures involved. There has yet to be a proposal for the creation of an enhanced co-operation project. The Government does not have particular priorities in mind but will examine any proposal on a case by case basis.
