223. Deputy John McGuinness asked the Minister for Arts, Heritage and the Gaeltacht further to Parliamentary Question No. 382 of 23 October 2012, the process by which this product can be considered under the regulations outlined; if he will confirm the requirement set out by the regulations with which the product did not comply; and if his attention has been drawn to the fact that the product is approved by other EU member states. As the Deputy is aware, the use of traps, snares and nets in relation to wildlife is governed by the Wildlife Act 1976 (Approved Traps, Snares and Nets) Regulations 2003. Regulation 3 of those Regulations approves certain types of traps, including, at 3(a)(ii), a spring trap. Such a spring trap must be designed to secure either the immediate death, or the immediate unconsciousness and subsequent death without intervening consciousness, of the wild birds or wild animals which it is designed to trap. I am advised that the product referred to by the Deputy in his Question does not fulfil this requirement. I am aware that the product in question is legal in at least one EU Member State.
